2. Scope of Application
These general terms and conditions apply exclusively to all online sales by TALENTTESTER to customers via the website https://www.talenttester.be/ (hereinafter "the website"). Any other general terms and conditions are excluded. Acceptance of these general terms implies the waiver of the customer's own terms and conditions.
These terms are the only applicable ones and replace any others, except in the case of a prior, explicit, and written agreement. TALENTTESTER reserves the right to amend specific provisions of these terms at any time, which is why customers should reread them with each visit to the website. For ongoing agreements, the version of the terms in force at the time of purchase remains applicable.
3. Formation of the Sale
A sale is concluded once the customer has completed payment. TALENTTESTER reserves the right to refuse any order, for any reason.
4. Transfer of Ownership
In deviation from Article 1583 of the Belgian Civil Code, all sold products remain the property of TALENTTESTER until full payment has been made. Despite this retention of title, the risk of loss or damage due to hacking transfers to the customer upon delivery.
5. Prices
All prices are listed in euros and are exclusive of VAT. Prices are subject to change. For placed orders, the price applicable at the time of the order will be charged.
In the case of an incorrect price publication (e.g., technical or human error), TALENTTESTER may
cancel the order.
6. Delivery
Orders are delivered via a link to the email address provided by the customer during the order. TALENTTESTER aims to deliver the products within 3 days of order confirmation. This delivery period is indicative and not binding.
Any complaint must be submitted in writing within 5 days of delivery.
7. Right of Withdrawal
The right of withdrawal is expressly excluded for digital content not provided on a tangible medium (Art. VI 53, 13° WER). The consumer acknowledges that they lose their right of withdrawal upon purchase of products offered by TALENTTESTER.
8. Privacy and Cookies
TALENTTESTER collects personal data via its website. These will be processed in accordance with the Belgian Privacy Act of 8 December 1992 and the EU GDPR Regulation 2016/679.
Depending on the case, TALENTTESTER acts either as the data controller or, in the context of recruitment assignments, as a processor on behalf of the employer. In the latter case, TALENTTESTER processes data strictly as instructed by the employer and ensures the rights of data subjects are protected.
The data is used for: website usage, service offering (e.g., talent testing), customer administration, processing and follow-up of orders, and direct marketing.

Upon your first visit, consent will be requested for non-functional cookies. Customers can modify their cookie settings at any time.
9. Limitations of Liability
Subject to stricter mandatory provisions, TALENTTESTER's liability is limited. TALENTTESTER is not liable for any damage due to errors in offers or due to unclear or incorrect content on the website or linked third-party websites.
The customer acknowledges that downloading or accessing information through the site or portal is done at their own risk. The customer is solely responsible for any damage to their system or data loss.
TALENTTESTER is not responsible for the customer’s recruitment process. In any case,
TALENTTESTER's liability is limited to the price of the sold product.
10. Use of Talent Tests for Recruitment
The customer acknowledges that TALENTTESTER only sells the tests and does not provide interpretation. Interpretation for recruitment must be conducted by a qualified psychologist. TALENTTESTER is not a recruitment agency, assessment center, or career office.
Tests may not be used by recruitment or interim agencies for hiring new staff. They may only be used to evaluate internal employees. Tests may not be resold or shared with third parties.
The tests reflect the self-perception of the candidate. Their reliability and usability depend heavily on the interpretation, motivation, and honesty of the respondent. Subjectivity will always play a role.
TALENTTESTER cannot be held liable for the use of the test results or their consequences.
11. Intellectual Property
All tests, behavioural analyses, questionnaires, reports, methodologies, visual materials, formats, and associated documentation developed or used by TalentTester.be are protected by copyright and remain the exclusive property of TalentTester.be.
The Customer acknowledges that these materials may not be copied, distributed, modified, translated, published, or otherwise used beyond the agreed services without prior written permission.
TalentTester.be declares that its testing tools and behavioural models are developed in-house and are not linked to any external commercial models unless otherwise stated.
12. Applicable Law and Jurisdiction
In case of disputes, only the courts of the judicial district of Antwerp, division Antwerp, shall have jurisdiction. Belgian law applies. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
